The Law & Your Obligations
What the NSW Swimming Pools Act requires of every pool owner
📖 About this guide: This is a plain-English summary of NSW pool fencing requirements under AS1926.1-2012 and the Swimming Pools Act 1992. It is designed to help you understand the key rules — not replace professional advice. For formal compliance, always engage a licensed certifier or contact your local council.

Drowning is the leading cause of accidental death for children under five in Australia. A compliant pool fence is the single most effective barrier between a child and the water — and in NSW it is a legal requirement, not a suggestion.

Always supervise swimmers regardless of age — never swim alone. During gatherings, always assign a designated responsible adult who is not distracted.

⚠️NSW LAW
Under the NSW Swimming Pools Act 1992 (as amended), every pool owner must ensure their pool is surrounded by a compliant child-resistant barrier at all times — year-round, not just at inspection. Councils conduct spot checks and can issue penalty notices up to $5,500 for non-compliance. If your barrier is modified or altered at any time, the current standard applies automatically.

Register Your Pool

All NSW pools must be registered at swimmingpoolregister.nsw.gov.au. This includes portable and inflatable pools that can hold 300mm or more of water.

A compliance certificate is required when selling or leasing your property, or when council directs you to obtain one. Issued by licensed certifiers or council.

Portable Pools

Inflatable and above-ground pools holding 300mm or more of water face the same fencing requirements as permanent pools. This is frequently misunderstood.

Which Standard Applies?
🚨KEY RULE
Regardless of when your pool was built, all pool fence inspections in NSW today are assessed against AS1926.1-2012. While older pools may technically sit under earlier standards if the barrier has never been modified, significant alterations or replacements to the fence, gate, or barrier may require compliance with the current standard. All new installations must comply with AS1926.1-2012. This guide covers AS1926.1-2012 only.

Old Pool

Age of pool makes no practical difference. Any modification to the barrier triggers AS1926.1-2012, regardless of original build date.

Any Renovation

Modifying your fence, gate, or yard in any way that affects the barrier automatically applies the current standard — no transitional period.

Selling or Renting

Compliance certificates for sale or lease are assessed against AS1926.1-2012. No older standard can be used for property transactions.

Note on AS1926.1:2024: A new version of the standard was published in August 2024 but is not yet in force in NSW. It is expected to apply to new pools from approximately May 2026 (imminent — check with your certifier for the latest) when NSW adopts NCC 2025 — though most states have historically delayed this. AS1926.1-2012 remains the current operative standard. This guide will be updated when the 2024 standard takes legal effect in NSW.

Fence Height & Non-Climbable Zone
The two measurements certifiers check first — and fail most often
Fence Height Requirements

The required height depends on the type of barrier and where it is measured from. Both are illustrated below — the measurement points are different.

The Non-Climbable Zone (NCZ)

The NCZ has three components — all three must be clear. It is the most commonly failed item in NSW pool fence inspections.

Horizontal Zone

No climbable objects within 500mm of the outside face of the fence, measured horizontally at ground level in all directions.

900mm Radius Arc
From Top Rail

A 900mm radius arc sweeps outward and downward from the top of the fence. Any climbable object within this arc on the outside is non-compliant — including objects that are beyond the 500mm ground zone but within the arc.

300mm Inside
Pool Side

No horizontal surfaces or footholds within 300mm of the inside face of the fence on the pool side — e.g. pool filter boxes, horizontal ledges.

Trees & Shrubs

Branches within either the 500mm ground zone or the 900mm arc from the top rail are non-compliant. Prune back permanently.

Outdoor Furniture

Chairs, tables, sun lounges — any piece a child could stand on must be moved entirely outside both NCZ zones.

Air Con Units

The casing is climbable. Fit a non-climbable collar, extend the fence with a raked panel, or relocate the unit outside the NCZ.

Pool Filter Box

Extremely common failure. Relocate outside the pool barrier or fence it off separately within its own enclosure.

Electrical Fittings

Outdoor power points and shower fittings near or on the fence must be recessed or permanently made non-climbable.

Raised Garden Beds

Rocks, retaining walls, garden beds, and planters that reduce the effective fence height must be moved outside all NCZ zones.

Gap Requirements & Key Measurements

Applies to pickets, slats, aluminium uprights, and glass panel edges throughout the full height of the fence. Apply gentle pressure — gaps that expand under pressure still count.
Horizontal climbable bar spacing
If horizontal rails are present on the fence

Horizontal bars must be at least 900mm apart. If closer, they must be made non-climbable (e.g. fillets at 60°). Hinges must also be 900mm apart or made non-climbable.

Gate Requirements
Gates are the #1 reason pool fence certificates are refused in NSW
HIGH RISK
Gates are the single most common cause of failed pool fence inspections in NSW. A self-closing mechanism that sticks even once, a latch that doesn't fully engage on every single closure, or a gate that opens toward the pool — any of these is an immediate fail. Test your gate thoroughly — at 30°, 60°, and 90° open — before booking any inspection.

Walk your fence before calling a certifier — every NO needs fixing first

Always supervise swimmers regardless of age — never swim alone. During parties, assign a designated responsible adult. Walk the full perimeter and tick YES or NO for every item below. Every NO is a likely inspection failure. Fix all NOs before booking your certifier. A failed inspection means a re-inspection fee ($150–$300) and delays. This checklist is a self-assessment guide only and does not guarantee a compliance certificate.
